The research
sought to answer the following questions:
1. Is humanitarian Intervention legal under current International
Law?
2. If no can it be legalized and under what parameters?
3. Should the only parameter be genocide and mass killing?
4. Should the intervening State or States obtain the authorization
of the United Nations Security Council before undertaking humanitarian
intervention?
5. Should the intervening State or States exhaust all peaceful remedies
including resorting to International Criminal Court?
6. Does the principle of obligation erga omnes of human rights constitute
a sufficient ground for humanitarian Intervention when there is
mass killing and genocide?
7. Does the principle of obligation erga omnes require all States
to be parties to the International Criminal Court even without their
ratifying the Statute of the Court?
